For the second time in a week, a Manitoba judge has tossed out a speeding ticket due to unreasonable delay in bringing the matter to trial, casting further doubt on the viability of untold numbers of similarly dated tickets.

Justin Segodnia had his speeding ticket stayed Tuesday after Judge Cynthia Devine ruled a 19-month delay between the day he was ticketed and the date his matter was set down for trial violated his Charter right to a speedy trial.

"The delay is more than twice as long as one would expect for a simple speeding offence," Devine said.

Segodnia was ticketed Oct. 18, 2014 at 8:23 a.m. after a police officer with a radar gun allegedly caught him driving 75 km/h in a 60 km/h zone over the Disraeli Freeway.

Court heard Segodnia was ready to proceed to trial Dec. 17, 2014, the date he entered his not guilty plea, but was given a trial date of May 24, 2016. He filed a delay motion seeking to quash the ticket in March.

"Although Mr. Segodnia took notes of the event, he did not take verbatim notes," Devine said. "He reasonably fears his memory may have faded over the intervening 19 months ... It is in society's interest to have these matters speedily decided."

The decision comes less than one week after Judge Mary Kate Harvie stayed a ticket for another motorist, Genevieve Grant, over an 18-month delay in bringing her case to trial.

"Although the Crown argued, as it did in the Grant case, that an increase in the number of matters being set down for trial and a scarcity of resources are at play (in the Segodnia case), there was little or no specific evidence to support these generalities," Devine said.

"Highway traffic matters lingering in the courts gathering dust are in no one's interest. Public confidence in the prompt and fair administration of justice requires a stay of proceedings in this case."

While a new pilot project has had some success in reducing the court backlog of such cases, it "comes too late for Mr. Segodnia," Devine said.

"The existence of the program, while laudable, cannot preclude Mr. Segodnia's Charter rights," Devine said.

The Grant decision involved a photo radar ticket while the Segodnia decision involved a ticket issued by a police officer.

The Segodnia decision "sets out that police tickets also pushing two years are unreasonable," said Todd Dube of watchdog group WiseUp Winnipeg. "It's an important decision."

Devine delivered her decision at 9 a.m., Tuesday, just one hour before Segodnia was set to stand trial.

"He's quite happy the decision went the way it did," said his lawyer Inderjit Singh. "Obviously, he would have liked to have dealt with it quicker."

The Crown has not indicated whether it will be appealing either decision.

"Since the decisions came so close together, they might decide to appeal both," Singh said.


Justice Minister Heather Stefanson told Postmedia last week she has met with departmental officials and has been told measures have been taken to reduce the backlog of traffic cases.

"It is a priority," she said. "I have been assured that there have been various steps that have been taken to reduce those backlogs thus far, but obviously there's still more work to be done. I'm concerned and I want to ensure that we do take care of this situation."

Rodney Bolianaz, a retired Winnipeg police traffic officer who now runs, said the Crown could still appeal the the Harvie decision, and those who have matters before the courts who think they'll now be tossed should pump their brakes.

"The Crown has the opportunity to appeal that decision. It's not like all of a sudden everyone's getting off because of this decision," he said.

"All eyes are now on the Crown attorney's office to see what they're going to do with this."

I've got a few wiring related odds and ends I need looked after, and I'm wondering if there's anyone people would recommend in the city that does good, clean work, preferably as a side job evenings and weekends.  Harness repairs, troubleshooting/diagnostics, command start work, etc.

Costco doesn't carry this size, Can Tire only has the base line, not the Eliminators, doesn't seem to be as common as I'd expect.  It's a common Toyota truck size, anyone know where to find a good one locally?

Selling for my brother, these ended up being the wrong size for his car due to his error, and he is now putting them up for sale.  Previous owner stated they had 2500kms on them, and from visual inspection it looks like they are brand new.  I measured them at 9/32 tread remaining, they had 10/32 when new.  They are located outside the city but can be brought in for a buyer, or if you're willing to travel for them the price is negotiable (he lives 2.5 hours west along the #1 hwy, Virden area).  Stored indoors in a heated area, out of direct sunlight, etc.  They show like brand new, he's asking $600obo picked up in WPG, willing to discount for a buyer that will meet him halfway or travel to him.  Any questions, please let me know.

I've got 2 of these to get rid of, I'll include the charging cable and wall adapter (lightning cable), and earbuds.  Both are in good condition, but the batteries are getting to the point where if I'm going out at night I need to stick it back on the charger to make sure I've got enough to get me through the night.  The batteries are replaceable.  They are both unlocked as they were purchased new from the Apple Store.  Looking to get $150 each OBO.  Let me know if you have any questions.

General Discussion / Temp insurance out of province conondrum

My brother is looking to buy a used car in AB, private sale.  He's flying to Calgary on Saturday, should arrive around 2:30PM AB time (3:30 MB time).  He's been told he needs a signed bill of sale before MPI will issue a temp permit, which he won't have until after he's had an opportunity to give the car a final look over, and exchange the funds with the seller.  He would have about 1/2 hour from when the plane lands, to when MPI's office that deals with issuing temp permits closes (4PM MB time).  Obviously this is not going to work smoothly, and he's looking for other options to have this car insured such that he can drive it back early Sunday morning.

He's contacted AB brokers, and has been told he needs a valid AB driver's licence for him to buy temp insurance through them, he used to have an AB driver's licence, but moved back to MB a few years ago and has a MB licence again.

Has anyone dealt with a situation like this?  Looking for ideas that I may have overlooked.

Not sure where to put this, but I called Partsource today, they informed me they sold all their loaner tools in the fall, and haven't replaced them yet, not sure if they're going to.  I believe Canadian Tire has gotten out of this game as well, so is there anywhere else in town you can rent/borrow something like a fan clutch holder/wrench set?  I'm looking for a holder and 36mm wrench specifically.

I've got a couple chips that need repaired, haven't had this done in 15+ years I bet.  Is there anywhere that's better than another, what's the lowdown on chip repair?  Should I wait for summer when all the little tents set up in grocery store parking lots, or go to a shop to have it done?  I'd like them to be as invisible as possible when completed.
